1. Introduction & Governing Law

Welcome to Nkatha Lauret (accessible at www.mustangmerchants.co.ke). These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "You") and Nkatha Lauret ("We", "Us", or "Our"), operating under the laws of the Republic of Kenya, including the Kenya Information and Communications Act (Cap 411A) and the Consumer Protection Act, 2012.

By browsing our website, creating an account, or placing an order, you agree to be bound by these Terms, our Privacy Policy, and our Returns Policy. If you do not agree with any part of these Terms, you must discontinue platform use immediately.

2. User Accounts & Security

To access certain features, including saved cart recovery, AI Virtual Try-On, and order history, you may be required to verify your email address via our passwordless One-Time Password (OTP) system.

• You must be at least 18 years of age or possess legal parental/guardian consent to enter into commercial transactions in Kenya.
• You are solely responsible for maintaining the confidentiality of your credentials and the devices used to access your account.
• You agree to provide accurate, up-to-date delivery and contact information (including a valid Kenyan mobile phone number for M-Pesa and parcel dispatch).

3. Products, Pricing & Availability

All prices quoted on the website are displayed in Kenya Shillings (KES / KSh) and include all applicable taxes unless otherwise noted.

• Curated & Vintage Apparel: Due to the curated, thrift, and vintage nature of certain clothing collections, slight variations in shade, texture, and distress may exist. High-resolution photos and detailed sizing notes are provided for transparency.
• Inventory Accuracy: We strive to maintain real-time inventory counts. In the rare event that an item is ordered concurrently and becomes unavailable, we will notify you promptly and offer an immediate exchange or a 100% refund to your M-Pesa account.
• Pricing Adjustments: We reserve the right to alter pricing and promotional discounts at any time without prior notice. Once an order is confirmed, the purchase price for that transaction is locked.

4. Payment Terms & M-Pesa Integration

We facilitate payments through Safaricom Daraja M-Pesa Buy Goods, direct Bank Transfer, and approved Cash on Delivery in supported metropolitan hubs.

• PIN Privacy: We will NEVER ask you for your M-Pesa PIN. The STK Push prompt is sent directly to your phone by Safaricom, and your PIN is entered securely via your SIM toolkit.
• Payment Verification: Orders paid via M-Pesa are verified automatically using Safaricom's transaction callback and reference numbers. An automated PDF receipt is emailed upon transaction completion.

5. AI Virtual Try-On & Uploaded Media

Nkatha Lauret offers an AI-powered Virtual Try-On (VTO) dressing room to help you visualize garments on personal or model photos before purchasing.

• Photo Ownership: You retain complete copyright and ownership over any personal photos you upload.
• Limited Processing License: You grant us a temporary, non-exclusive license solely to process your image through our secure neural network to render clothing garments onto your figure.
• Prohibited Content: You must not upload any unlawful, obscene, pornographic, or non-consensual imagery. Violations will result in immediate permanent account termination and referral to relevant Kenyan authorities under the Computer Misuse and Cybercrimes Act, 2018.

6. Shipping, Delivery & Inspection

Dispatch timelines, courier partners, and shipping rates are detailed in our Shipping Policy. Risk of loss and title for products pass to you upon delivery by the courier partner or rider to your specified address or parcel office.

7. Intellectual Property

All website content, user interfaces, editorial photography, branding, graphic design, logos, and custom web software are the exclusive intellectual property of Nkatha Lauret and its technology partner CrownTech LLC, protected under Kenyan and international copyright laws.
